Five Convicted in Six Days for Sexually Assaulting Children

Katty* couldn’t afford a lawyer and almost dropped her case against the man who raped her as a teen.

But this month, IJM’s Bolivia team helped convict him and four other criminals over a six-day period, a remarkable event in a country where sexual assault cases can languish for years and are often never resolved.

The five perpetrators included the man and his accomplice, who posed as taxi drivers and knocked Katty unconscious before raping her when she was 17. Judges sentenced one man to eight years in prison and another to 15 years.

Bolivian prosecutors referred Katty’s case to IJM in 2014 after she told them she could not pay for a lawyer. They sent her to IJM, which offered Katty free legal representation and counseling, as well as victim-sensitive support as she prepared to share her story during her trial.

On Tuesday, Katty waited outside a courthouse in El Alto and began crying as an IJM attorney told her the men who attacked her had been sentenced to prison. Two years after the attack, she was finally safe.

In three other cases heard separately between May 19 and May 24, IJM helped secure convictions against perpetrators with sentences ranging from 10 to 20 years in prison, sending a strong message that sexually assaulting children in Bolivia is a serious crime. One man had raped his 10-year-old niece under his own roof.

The convictions came at a time when sexual assault cases moving through courts in La Paz and El Alto had all but ground to a halt. But recent judicial appointments—and a restructuring of local courts that will give special attention to violent crimes—are creating hope for swifter justice for survivors of sexual assault.

Later this year, IJM will begin a large-scale, multi-year training program for judges and prosecutors in La Paz and El Alto to improve the handling of child sexual assault cases and dramatically increase access to justice for poor Bolivians.

IJM has worked in Bolivia for nearly ten years to rescue victims of sexual violence, bring perpetrators to justice, restore survivors, and to improve the justice system’s ability to reduce everyday violence.


Cinco sentenciados en seis días por agredir sexualmente a niños

Katty* no podía pagar un abogado y por eso casi abandonó su caso en contra del hombre que la violó cuando era adolescente.

Pero este mes, durante un período de seis días, el equipo de IJM Bolivia ayudó a conseguir su condena y la de otros cuatro delincuentes, un evento notable en un país donde los casos de violencia sexual pueden demorar años y con frecuencia nunca se resuelven.

Los cinco perpetradores incluyeron al hombre y su cómplice, quienes haciéndose pasar por taxistas, dejaron a Katty inconsciente antes de violarla cuando tenía 17 años. Los jueces sentenciaron a un hombre a ocho años de prisión y al otro a 15 años.

Los fiscales bolivianos remitieron el caso de Katty a IJM en el año 2014, después de que les dijera que no podía pagar por un abogado. La enviaron a IJM, que le ofreció representación legal gratuita, terapia, y apoyo sensible a la víctima mientras se preparaba para compartir su historia durante el juicio.

El martes, Katty, quien esperaba fuera de un tribunal en El Alto, comenzó a llorar cuando un abogado de IJM le dijo que los hombres que la habían atacado habían sido sentenciados a prisión. Dos años después del ataque, finalmente estaba a salvo.

En otros tres casos que se escucharon por separado entre el 19 de mayo y el 24 de mayo, IJM ayudó a asegurar las condenas contra los perpetradores con sentencias que van de 10 a 20 años en prisión, condenas que envían un fuerte mensaje de que agredir sexualmente a niños en Bolivia es un delito grave. Un hombre había violado a su sobrina de 10 años bajo su propio techo.

Las condenas llegaron en un momento en que los casos de agresión sexual en los tribunales de La Paz y El Alto parecían estar prácticamente estancadas. Pero, los recientes nombramientos judiciales y una reestructuración de los tribunales locales que prestará mayor atención a los delitos violentos están creando la esperanza de una justicia más rápida para los sobrevivientes de violencia sexual.

Este año, IJM comenzará un programa de capacitación multianual a gran escala para jueces y fiscales en La Paz y El Alto para mejorar el manejo de casos violencia sexual infantil y aumentar drásticamente el acceso a la justicia para los bolivianos pobres.

IJM ha trabajado en Bolivia por casi diez años para rescatar a las víctimas de violencia sexual, llevar a los perpetradores ante la justicia, restaurar a los sobrevivientes y mejorar la capacidad del sistema de justicia para reducir la violencia cotidiana.
